Prudential Center Insurer Files Suit Over Injured Worker’s Claim

The insurance company responsible for the Prudential Center in Newark, New Jersey filed a federal lawsuit Wednesday against two subsidiaries of Liberty Mutual Insurance regarding an injured worker’s case. New York Marine & General Insurance Co. is seeking $3 million in coverage from Ohio Casualty Insurance Co. and Liberty Insurance Corp. for a paralyzed worker who fell 16 feet while pulling wires in the arena. The defendants argued their coverage maxed out at $1 million but New York Marine filed a case in New Jersey’s District Court to challenge the priority of coverage and ask that the subsidiaries cover more of the awarded damages.

The injured worker sued the arena, his employer, and a contractor on-site in Essex County Superior Court. Devils Arena Entertainment, the managing company of the arena, and the contractor had the insurance through the subsidiaries to cover the electric company’s work, which they believe includes the lawsuit via an equitable subrogation claim. The complaint states that Ohio Casualty Insurance Co. must cover an additional $2 million in damages.
